On 17 January 2024, the ATO released its long-awaited guidance on the characterisation of payments for software and intellectual property rights, and whether these constitute “royalties” to which withholding tax applies (read our alert).  The ruling has potentially far-reaching consequences for taxpayers in the industry, particularly due to the ATO’s broad views as to what constitutes a “royalty” and what arrangements are considered “high risk”.
