We are pleased to invite you to a joint event with ACICA 45, for a panel discussion in relation to ‘A Clash of Cultures – Exploring the Impact of Culture on Advocacy in International Arbitration’.
One of the most intriguing aspects of a career in international arbitration is the opportunity to engage in dynamic work that traverses international borders. Often, this statement holds true not only in relation to the underlying dispute, but also the backgrounds of the various participants to the proceedings.
The arbitral tribunal, the parties, counsel and experts more commonly comprise a diverse mix of individuals from civil law and common law backgrounds - different jurisdictions each with distinct legal, political and cultural norms - than is the case in litigation. In these circumstances, it is perhaps inevitable that a range of cross-cultural considerations will arise in the advocacy process. Those factors may influence the manner in which the parties present their cases (e.g. the style of the witness examinations) and may result in miscommunications, particularly where language barriers are present.
