As a leading world economy and a recognised pro-arbitration jurisdiction, the USA is an attractive destination for award-holders seeking the recognition and enforcement of foreign arbitration awards. Once an award is enforceable as a USA judgment, there are a range of enforcement and discovery procedures to trace and seize the counterparty’s assets to satisfy the judgment.

But how straightforward is enforcement in the USA? What do you need to do to convince a USA Court to enforce a foreign award? What are the risks and benefits of enforcement action in the USA? How does the USA fit into a global enforcement strategy?

King & Wood Mallesons’ New York team have experience in enforcing and defending against enforcement of domestic and foreign arbitral awards. Just last week, King & Wood Mallesons helped a Chinese SOE client successfully resist the enforcement of an award in the US District Court for the District of Columbia.
